If you believe there are circumstances or reasons for the withdrawal of an expiation notice you can submit an appeal online via the Parking Review Form below.

Please note:

  • The Expiation of Offences Act 1996 includes provisions that allow an expiation notice to be withdrawn if certain circumstances exist, or if the offence could be considered trifling as defined by the Act.
  • Expiation of Offences Act 1996 8A – Review of notices on the ground that offence is trifling (see link below)
  • One right of review is only accepted unless new evidence is provided to substantiate another review. Council may not reply to correspondence that does not meet these criteria.

4. Were signs or road markings relevant to this offence totally obscured or not erected in accordance with Australian Standards or Australian Road Rules?

6. Was the offence trifling or were there compelling humanitarian or safety reasons whereby you could not, in all circumstances, reasonably have averted committing the offence?

To be considered trifling it is not simply that you think it is trifling or petty, there must be one of the following: 1. Compelling humanitarian or safety reasons which led to the offence occurring; or 2. Driver could not in all circumstances have reasonably averted committing the offence; or 3.The offence was merely technical, trivial or petty example of the offence (e.g. – redundant signage etc.) Please scroll to the bottom if you would like to add a statement of appeal
